Krasnoyarsk railway. The Krasnoyarsk Railway is the heart of the Trans-Siberian. Signaling, interlocking and blocking distances

The article deals with the questions that most often arise among tourists shortly before leaving for a foreign tour:

  1. Under what conditions can they not be released abroad
  2. How to check if there is a travel ban
  3. What to do if there is a debt / ban

As the holidays approached, the media increasingly began to raise the topic of debts and fines, the owners of which are prohibited from traveling abroad. Let's figure out under what conditions you may be denied crossing the Russian border and what to do to avoid this.

Do you want to go abroad? Pay off your debts!

So, in 2018, you may not be allowed to leave the country if there is a court decision to collect debt from you and enforcement proceedings initiated by a bailiff. In the absence of such production, problems with customs clearance should not arise.

They will not prohibit you from going abroad even if you have a debt of less than 10,000 (in some cases, referred to in Article 67 of the Federal Law-229 “On Enforcement Proceedings”) / 30,000 rubles. In this case, the bailiff does not have the right to restrict departure and there will be no problems at the airport.

But it is possible to leave the country with a debt exceeding the amount of 30,000 rubles. In this case (when enforcement proceedings are initiated), the bailiff makes the decision to ban.

For what debts can you be deprived of a trip abroad?

  • for tax arrears (including land and transport),
  • for loan debt
  • for traffic police fines,
  • for debts on alimony, credit, housing and communal services and rent,
  • for other debts and non-payment.

Let's try to figure out how it all happens. Let's say you have a debt or debt for housing and communal services, or maybe you forgot to pay a traffic police fine. Representatives of a bank or organization are suing you. You receive a summons, although a court decision may be made without your participation.

If the court recognizes the charges as justified, then a decision is made to collect the debt and the case is transferred to the bailiff of your district. The latter, in turn, decides to restrict your departure and initiates enforcement proceedings. This information is sent to the border service of the FSB of the country, and your data is entered into the database of debtors.

At the same time, persistent non-payers should remember that enforcement proceedings can be initiated a few days before the date of departure. And you may well find out about the travel restriction only at the airport. Therefore, if you have debts, fines or overdue loans, it is better to pay them off in advance or check if they allow you to safely cross the border.

Am I going abroad or not - online test

Thanks to the development of technology, you can find out without leaving your home on the website of the Federal Bailiff Service - fssprus.ru. When entering the last name, first name and patronymic, date of birth, as well as the region of residence, you will receive information about current and completed enforcement proceedings for a given period of time, their reason, with the start and end dates. But even if the FSSP website tells you that everything is fine, and you know that you have debts, you cannot be 100% sure that the production will not start shortly before your departure date.

To get complete information about your fines, debts and other debts, as well as to see the likelihood of a ban on traveling abroad, take a look at the website Non-departure.rf. For verification, only your name, surname, series and passport number are required. The advantage of this site is the prompt updating of data on the institution of enforcement proceedings. At the same time, this information may appear on the FSSP website with a delay of up to 14 days. But you have to pay for the efficiency and completeness of the data. The service for checking the travel ban Nevylet.rf is paid. The cost of one check is 300 rubles.

So, you have learned about the presence of debt. What to do next?

Limit of 10,000 / 30,000 rubles

If enforcement proceedings have been initiated and the amount of debt is more than 30,000 rubles, then the only way is to pay it off. If the debt does not exceed the amount of 30,000 rubles or there is no court decision yet, then you can not pay anything. But at the same time, it is worth remembering that the risk of being stopped at the border remains, because the case can be opened after your last check.

Since 2018, if the debt does not exceed 30,000 rubles (or 10,000 rubles, in some cases - see Article 67 of the Federal Law-229 “On Enforcement Proceedings”) - the bailiff does not have the right to make a decision to restrict travel outside the Russian Federation.

Have you decided not to risk and pay your debts? Remember that information about their repayment does not reach the border guards and bailiffs immediately. It can be delayed up to 14 days. Therefore, it is recommended to part with debts at least two weeks before departure.

Fines can be paid both at the bank (according to the receipt) and on the Nevylet.rf website. After that, it is advisable to receive a copy of the decision to terminate the enforcement proceedings from the FSSP, including evidence of the lifting of your travel ban. After all, it is the termination of enforcement proceedings, and not the payment of your debt, that is the condition for your release abroad. Take a copy of the decision with you to the airport. Although it is not a guarantor of your passage through border control. The decision of the border guards will be based only on the presence or absence of your last name in the database of debtors.

A considerable number of people, having taken a loan from a bank, are faced with all sorts of problems. The main problem of most Russians today is the impossibility of timely repayment of the loan. Having become a bank debtor, a person involuntarily becomes his hostage and falls into.

Already more than 900,000 people were unable to travel abroad in 2019. Therefore, we recommend that you check in advance the possibility of your travel to foreign countries using all databases using a proven service.

Russian legislation clearly states that. They do not release only those whose debt reaches 30 thousand rubles and exceeds it. If the amount of the debt is below 30 thousand rubles, then a ban on visiting abroad in 2019 cannot be imposed.

What to say the law

According to existing legislation, a decision can be made in relation to the debtor to restrict travel abroad. But this is an extreme measure. Usually, before making a citizen restricted to travel abroad, the state repeatedly warns him about the restriction that threatens him and asks him to pay off the debt.

The work of bailiffs with debtors is often unpleasant

Sometimes a person who urgently needs to go abroad comes across a sharp "pitfall". Trouble may arise when he does not live at the place of registration. Also, the notice may be delivered late or simply lost in the mail.

In this case, a citizen who urgently needs to go abroad faces serious consequences. Many people learn that they are prohibited from traveling abroad only when going through the passport control procedure.

Therefore, to prevent this from happening, we recommend that you quickly check all debts online at.

Who is at risk of being banned from traveling abroad?

A citizen who is faced with the need to travel abroad should be aware that restrictions on his movement can only be imposed as a result of obligations. They are imposed by the court. But first, the court must take place and a person who is faced with the need to urgently travel abroad must be invited as a defendant.

The restriction of the debtor's rights to free movement is relevant until he repays the debts and notifies the appropriate authorities about this.

Theoretically, every person who has relations with financial organizations of the Russian Federation can become “not allowed to leave the country”. This can happen when the decision on the restriction is adopted in absentia. But such a harsh measure can only affect "inveterate" debtors who neglect their duties.

Is there a black list

The definition of "black list", which frightens many debtors, exists at an unofficial level. The black list includes citizens who could not or did not want to pay their debt to a financial institution on time. This can only happen once.

But most often, only those debtors who systematically neglect their obligations to the bank get into the “terrible” list.

Each financial institution sets its own loan repayment terms. These deadlines must not be violated. Otherwise, the debtor faces a hefty fine. But the imposition of a fine does not mean that the debtor has not added to the black list.

It is up to the bank to decide whether or not to include a non-payer in the terrible list and whether or not to make him “not allowed to travel abroad”. Typically, the register includes those debtors who take out a loan and are not going to repay it. Such debtors are wanted by the judicial system.

Lists of bank debtors can be:

  • private;
  • collection;
  • BKI lists.

Third parties access to private information is also prohibited. Credit history is a purely "internal" matter. Taking into account the credit history, the bank subsequently decides whether to continue to trust the borrower.

If the borrower often and for no good reason violated the bank schedule, then he is denied a subsequent loan.

Features of the lists of bailiffs

The natural decision of the bank, faced with an unpaid loan, is to go to court. In this case, the database of all debtors is sent to the bailiff service. Each person who is going abroad can find out if his name is on the list among others "not allowed to travel abroad" on the website of the bailiff service.

If the citizen continues to ignore his obligations, the court decides on the enforcement of the loan amount. Also, the defaulter undertakes to pay legal costs. In some cases, the court makes a decision regarding the sale of collateral real estate.

Sanctions for defaulters

One of the main sanctions that apply to a non-payer is. It is important to bear in mind that the bank cannot make a decision to restrict travel outside the state on its own. A travel ban is imposed only by a court.

The bank can only act as an initiator for the non-payer to become "not allowed to travel abroad". The initiative not to leave the state is based on the fact that the debtor has money, but for some reason he does not want to repay the loan. Statistics say that every 12 months, 900,000 Russians are blocked from traveling abroad by a corresponding sanction.

When going on vacation or business abroad, you should make sure that you do not have any debts on loans or decisions of the bailiffs to pay the debt that you did not pay off on time. Without this condition, you will most likely not be released from the country. The probability of such an outcome increases depending on the amount of debts. This includes fines. The total amount of payments that you must pay must not exceed 10 thousand rubles. Therefore, before leaving, be sure to take care of payments. To find out about all debts, you can contact banks or bailiffs personally. However, this method requires a lot of time and effort. As an alternative way, you can view all debts via the Internet right at home. In this article, you will learn how to check debt before going abroad in several ways.

Most people who travel abroad from time to time know that not everyone can cross the border. There is a certain list of people not allowed to travel abroad, which consists of several categories.

Who is at risk of being banned from traveling abroad?

People are banned from traveling for a variety of reasons. Often this is related to work. In such cases, citizens are usually aware that they cannot leave, because when they are employed, they are informed about this against signature. There are other categories of persons who are prohibited from traveling abroad. Here is their list as of 2019:

Banks and collection agencies also have their own lists of debtors.. For a small delay, it is unlikely that someone will be brought there: there are too many such people. Usually it includes those who allow long systematic delays or from the very beginning, having taken a loan, do not want to return it. Bailiffs who work with debtors have similar lists.

Usually a person has practically no access to information, whether he is on one of these lists or not. In banks, they are private, in addition, each bank manager often has his own list of debtors.

These employees are not entitled to disclose private lists. This is the disclosure of personal information, and it is punished by the state very severely. Since this is a violation of a constitutional human right, it will be possible to sue the bank that allowed it.

Such a black list of debtors is unofficial and generally does not affect the possibility of going abroad. Nevertheless, it is better not to fall into it, because the next step may be a lawsuit with a creditor and imposing restrictions on foreign travel.
