Is it possible to have dual citizenship of Russia and Ukraine

Today you can often hear the concept of "dual citizenship". In order for residents of a particular country to be able to obtain dual citizenship, appropriate agreements must be concluded between states.

Russian legislation on the basis of Art. 62 of the Constitution regulates that, if there are relevant international agreements. At the same time, there is no need to renounce Russian citizenship, unless it is provided for by the legislation of the second country. Foreigners and people who do not have citizenship live in the country with the same rights as Russians, except for situations that are stipulated in the Federal Law


At the moment, there are agreements that allow dual citizenship with Turkmenistan and Tajikistan. At the same time, children who are born to people with dual citizenship are also entitled to it. Thus, it is impossible to have dual citizenship - Russia and Ukraine - without the permission of the relevant authorities. However, the Law concerns agreements that have been reached.

If a Russian citizen decides to acquire citizenship of a state that has not concluded an agreement with Russia, then this is not a crime, but it will not work on the territory of the country. The zone of the law of dual citizenship of Russia-Ukraine is limited by the constitutions of the two countries. But in this case, we are not talking about dual citizenship, but, perhaps, about a second citizenship. Obtaining another citizenship does not oblige you to renounce the one you already have.

Today, the situation in Ukraine is very difficult, and relations between this country and Russia are very tense. This creates certain difficulties for the citizens of both states. If Russian legislation allows its subjects to have dual citizenship - of Ukraine and Russia, then in Ukraine the situation is different.

The legislation of Ukraine is very imperfect. It recognizes dual citizenship as illegal and unacceptable. Therefore, the citizens of this country often look for other ways to obtain citizenship, for example, Russia. The prohibition is indicated by Art. 4 of the Ukrainian Constitution.

The article "On Citizenship" says that a person may lose his passport if he lives or works in the territory of another state. At the same time, if a Ukrainian has acquired the citizenship of another country, then he does not lose the rights and obligations assigned to him by law. In order to avoid fines and punishment, you must first get out of Ukrainian citizenship, and then get a passport of another country.

The process of obtaining dual citizenship for a Ukrainian can be carried out through obtaining permanent residence in the territory of another state.

The legislations of Russia and Ukraine have serious differences on this issue. There are several reasons why Ukrainians and Russians want to obtain citizenship from other countries. In particular, these are economic difficulties, difficulties with work, low wages. Due to the political situation, is the way out.

But, for example, Art. 14 of the Law "On Citizenship of Russia" says that foreigners and stateless persons have the right to apply for if they have been living in the country for at least five years. You may be given a Russian passport if you were born in the USSR or on the territory of the RSFSR. It turns out that, on the one hand, there is no explicit requirement to withdraw from Ukrainian citizenship in the legislation. However, since there is no international agreement between Russia and Ukraine, a choice will have to be made. It turns out that in order to become a citizen of Ukraine, one must renounce Russian citizenship and vice versa.

The President of the Russian Federation signed a law that allows Ukrainians to go through the procedure for obtaining Russian citizenship in a simplified manner. Under the new rules, future citizens of the Russian Federation will have to take an oath.

On April 24, 2019, it entered into force that residents of the LPR and DPR have the right to obtain Russian citizenship under a simplified scheme. You can submit documents immediately upon arrival in Russia. It is not necessary to comply with the condition on the required period of stay, confirmation of the source of income, knowledge of the Russian language and renounce existing citizenship.

It is known that the introduction is planned. Therefore, to cross the border, you will need to issue a foreign passport and obtain a visa. Dual citizenship would make crossing the border much easier.

Is it possible for a Russian citizen to obtain Ukrainian citizenship?

For quite a long time there was a visa-free regime between the countries and border crossing, and even temporary residence was quite possible. However, the situation has changed. Sometimes Russian citizens need to have a Ukrainian passport. By law, the Russian has the right to do so. But the Ukrainian authorities may demand the renunciation of Russian citizenship. In order to enjoy the rights of a citizen of Ukraine, you need to present documents on withdrawal from Russian citizenship. The process of obtaining a passport of this country is long.

Those who were born on the territory of Ukraine or lived there during the Soviet era have the right to obtain citizenship under a simplified scheme. Having relatives will make things easier.

In turn, to become a Russian, a Ukrainian will have to give up his passport. However, due to the difficult political situation in Ukraine, there is a simplified scheme that allows you to take Russian citizenship in a short time.

If a Russian citizen decides to obtain a second citizenship, then he has every right to do so. True, in some cases, the Ministry of Internal Affairs does not pay attention to the lack of renunciation of Ukrainian citizenship.
