New amendments to the traffic police 8 changes. Is it possible to film a traffic police officer under the new law

On October 20, new rules for traffic police officers come into force. The administrative regulations are an internal document, but will affect all drivers - in fact, this is an instruction for inspectors on how to behave with drivers.

Brake drivers anywhere

One of the main innovations is that traffic police officers can stop cars for checks anywhere. This means that they have the right to follow the traffic as they like: at a stationary post, in a car, and even without a patrol car. However, each employee chooses a place not at his own discretion, but solely on the orders of his superior.

Now inspectors are forbidden to stop cars outside stationary posts. Often, this ban was used by motorists who were set up for conflict: they immediately turned on the camera, started asking questions - they say, on what basis are you stopping me? This led to conflicts, which will no longer exist - it will be possible to stop everyone in a row and everywhere.

Each crew has a special route map with them, which indicates where exactly the police should serve. The driver can verify the legitimacy of the work of the crew by calling the traffic police on duty at 26-42-30.

Ambushes in the bushes

The ambushes of traffic police officers, described in numerous jokes, are now legalized. On the one hand, the regulation notes: “The patrol car must always be clearly visible from afar to all participants traffic". However, the document also provides for concessions: if photo and video recording of violations is carried out, as well as on emergency sections of roads, a traffic police car can be masked using natural terrain in places with limited visibility. In particular, it is allowed to hide behind turns, hillocks and objects road infrastructure. But this question is not so fundamental. If you are driving in compliance with traffic rules, then you do not care where the patrol car is parked - in the bushes or right on the road.

"Unfasten your rights!"

When stopping, the inspector has the right to require the driver to present documents. Now they will need to be shown not only without a cover, but also without “holding devices”: we are talking, in particular, about iron chains with which some drivers tie their licenses so that the inspector does not take them to the patrol car for inspection.

Filming the driver

The regulations set out and new normal, according to which inspectors will be able to use "special technical means" (primarily cameras) belonging not only to the state, but also to "municipal bodies, public associations and organizations"

According to the traffic police, such an amendment is necessary due to the fact that in some regions automatic cameras belong to private companies, such as in Moscow and the Moscow region.

Inspector filming ban

The new regulation removed the norm allowing the filming of traffic police inspectors. If earlier the traffic police officer had no right to prohibit filming, now he can simply say: "Don't shoot me, I'm against it." In this case, the citizen is obliged to remove the video camera.

If the driver does not listen to the inspector, he is threatened with involvement under Article 19.3 of the Code of Administrative Offenses of the Russian Federation - “Disobedience to a lawful order or demand of a police officer”, which entails the imposition of an administrative fine in the amount of five hundred to one thousand rubles or administrative arrest for up to fifteen days. This is an important change, which means that the actions of traffic police officers, including illegal ones, can no longer be recorded.

Get out of the car on demand

According to the new regulation, the inspector has the right to ask the driver to get out of the car in case of signs of intoxication or illness. Simply put, the driver is obliged to exit whenever required by a traffic police officer. He will also have to get into a patrol car, if the peace officer wants it.

How will they deal with drunk drivers?

A separate paragraph in the regulations states that the basis for an examination for the state of alcoholic intoxication is the smell of alcohol from the mouth, instability of posture, speech impairment, a sharp change in the color of the skin of the face, behavior that does not correspond to the situation. At the same time, before the examination, the police officer is obliged to remove the driver from control in the presence of two witnesses or using video recording. If a medical examination in the hospital shows that the motorist is sober, then the inspectors will be required to return him back to his car.

The inspectors were not allowed to smoke

The new regulations do not include a ban on smoking when the inspector communicates with the driver. Note that earlier it became known that traffic police inspectors are going to ban smoking and rude language during a conversation with road users. The corresponding initiative was contained in the version of the regulation published on the portal of regulatory legal acts. However, the ban on smoking in the presence of the driver disappeared from the final version of the document.

A representative of one of the regional traffic police departments recalls that now inspectors are forbidden to stop cars outside stationary posts. Aleksey Dozorov, chairman of the Moscow regional branch of the Committee for the Protection of the Rights of Motorists, believes that this issue is not so fundamental. “If a person is driving in compliance with the traffic rules, then he does not care where the patrol car is parked - in the bushes or standing right on the road,” he explained.

"Unfasten your rights!"

When stopping, the inspector has the right to require the driver to present documents. “Many drivers actually do just that - in literally fasten their rights. When you ask them to hand over the documents, they simply smirk in response - that's how I handed it over, look. This is some kind of stupid play on words, so they decided to get rid of it, ”explained a traffic police inspector in one of the Russian regions.

Filming the driver

The regulation also enshrined a new rule, according to which inspectors will be able to use "special technical means" (primarily cameras) belonging not only to the state, but also to "municipal bodies, public associations and organizations."

It will no longer be possible to shoot "traffic cops" on video

According to the traffic police, such an amendment is necessary due to the fact that in some regions automatic cameras belong to private companies, such as in Moscow and the Moscow region. IN Ulyanovsk region maintenance of video recording complexes is entrusted to the city authorities, that is, the State traffic inspectorate has an indirect relation to them.

Inspector trolling ban

The new regulation removed the norm allowing the filming of traffic police inspectors. If earlier the traffic police officer had no right to prohibit filming, now he can simply say: "Don't shoot me, I'm against it." In this case, the citizen is obliged to remove the video camera.

“This is an important change, which means that the actions of traffic police officers, including illegal ones, cannot be recorded.
I think that the drivers themselves are largely to blame for this, who for many years in 90% of cases were openly trolling inspectors on the roads. Now this has been put to an end, ”explained Sergey Kanaev, head of the Federation of Russian Car Owners.

Many provisions of the new regulation play into the hands of traffic police officers

Get out of the car on demand

According to the new regulation, the inspector has the right to ask the driver to get out of the car in case of signs of intoxication or illness. Simply put, the driver is obliged to leave whenever the traffic cop requires it.

The inspectors were allowed to smoke

The new regulations do not include a ban on smoking when the inspector communicates with the driver. It should be noted that in August it became known that the traffic police inspectors were going to ban smoking and rude language during a conversation with road users. The corresponding initiative was contained in the version of the regulation published on the portal of regulatory legal acts. However, the ban on smoking in the presence of the driver disappeared from the final version of the document.

Shooting a traffic police officer on camera is a mandatory procedure, and sometimes such a video recording can serve the only proof his violations. But against the backdrop of the release of the new Order No. 664, along with the Administrative Regulations, the Internet was flooded with news that supposedly now this can not be done. Is this true and is it possible to film a traffic police officer under the new law for 2017, let's look at it with links to current legislation!

Changes in the Administrative Regulations affected most of it. And one of them, which is interesting for us in this article, was the removal of the clause on the prohibition of the traffic police inspector from obstructing the video recording of the driver. But, nevertheless, all the news about the ban on filming a traffic police inspector and even where it simply says that the clause on allowing video filming has been removed from the regulations is nothing more than a "duck".

Nothing has been removed from the regulation, the wording has simply been changed, and this rule has been moved to a new paragraph.

However, the wording has been slightly changed, and its meaning, along with the wording, too. There is more logic, because the regulation is intended for police officers (who are the traffic police inspectors), and if earlier it was expressly stated "not to interfere", now we are only talking about filming administrative procedures by the employees themselves (such as car inspection, examination for intoxication and others ).

Direct permissions for filming by the driver of the traffic police inspector are in other regulatory legal acts.

On what basis is it possible to remove an employee in 2017?

There are two legal acts that provide almost directly that it is possible to write down the traffic police inspector when he stopped you, draw up a protocol against you or issue a resolution. Let's take a look at them!

The first of them is the Federal Law "On the Police", the foundations of which (Article 8) provide for the openness of the activities of the police in the exercise of human rights functions:

1. The activity of the police is open to the public to the extent that it does not contradict the requirements of the law. Russian Federation about criminal proceedings, on proceedings in cases of administrative offenses, on operational-search activities, on the protection of state and other secrets protected by law, and does not violate the rights of citizens, public associations and organizations.

As you can see, the right to film a traffic police officer on camera directly follows from the principle of openness of police activities. And so you can record on video all the actions of the inspector.

The second normative act relating to our topic is the Federal Law "On Information", article 3 of which also provides for the openness of the activities of state bodies:

Legal regulation relations arising in the field of information, information technology and information protection is based on the following principles:
....
3) openness of information about activities government agencies and local governments and free access to such information, except in cases established by federal laws;

Note that both of the above laws are federal laws and they have one of the highest priorities when conflicts with other legal acts arise. So, the new Order No. 664 has a much lower priority, even if there was a direct ban on filming a traffic police officer on camera.

Thus, we can safely conclude that it is possible and even necessary to record the inspector's procedural actions for 2017.

Do I need to warn the inspector about the shooting?

Again, nowhere is there a direct ban on videotaping a conversation with an inspector without clarifications and subtleties. Therefore, you can record a conversation both publicly, warning the employee that you are recording it, and covertly, without announcing the presence of video filming.

On Friday, October 20, a new administrative regulations for employees of the State traffic inspectorate. The document actually expands the powers of traffic police inspectors, who now have full right stop drivers anywhere or, for example, forbid them to film themselves on camera. The media have compiled a list of eight innovations that are unlikely to please, including Ulyanovsk motorists.

1. They can stop anywhere

An interlocutor of URA.RU from one of the regional departments of the traffic police explained that if now inspectors are forbidden to stop drivers outside stationary posts, then from Friday to slow down suspicious or dialed too great speed machines they can virtually anywhere. The innovation is supposed to help eliminate the possibility of conflict situations between the inspection staff and drivers.

2. The inspectors were allowed to sit in ambush

With the entry into force of the new regulation, inspectors will be allowed to ambush drivers who break the rules. The condition for this, according to the new document, will be the need to conduct photo or video recording of violations. The regulation will allow traffic police to hide behind turns and road infrastructure.

3. The inspector will be able to demand to untie rights from the dashboard

As it turned out, some drivers literally tie their rights to the dashboard of the car, using various kinds of metal chains for this. They do this in order to prevent the inspector from taking the documents to be checked in the patrol car. However, now the inspector will have every right to demand that rights be shown to him not only without a cover, but also without a chain - they will have to be untied.

4. Drivers were allowed to film

The new document secured the right of inspectors to film drivers, not only on traffic police cameras, but also on cameras of third-party organizations. According to URA.RU, this item appeared in the regulations, since in some regions private companies or municipal authorities, and not the State traffic inspectorate, are responsible for video recording of the traffic situation.

5. Inspectors banned from filming

But the inspectors themselves are now prohibited from filming. The recording device will have to be removed at the first request of the traffic cop, otherwise the driver will face an administrative article “Disobedience to a lawful order or demand of a police officer.” She assumes different types punishments range from fines to arrest.

6. Asking to get out of the car

Now the traffic police will have the legal right to ask the driver to get out of the car, and he, in turn, did not receive the legal right to refuse. In other words, as soon as the employee who stopped you asks you to leave your car, this must be done without wrangling.

7. Dealing with drunk drivers

What, according to the new regulation, can be considered grounds for a medical examination for alcohol intoxication: a characteristic smell from the mouth, an unstable posture, slurred speech, behavior inappropriate to the situation. At the same time, if the inspector suspected the driver and intends to conduct an examination, he must first remove him from control vehicle in the presence of two witnesses or using a video camera. And if after that a medical test showed that the motorist is sober, then the inspector is obliged to deliver him back to the car.

As we already reported, from October 20, a new administrative regulation for traffic police officers comes into force. The document seems to be internal, but it will affect all drivers - in fact, this is an instruction for inspectors on how to behave with them.
Therefore, we decided to focus your attention on what you now need to be prepared for when meeting with an inspector on the road. The new regulations were meticulously understood by URA.RU.

1. Traffic police officers can now stop cars for checks anywhere. This means that they have the right to follow the traffic as they like: at a stationary post, in a car, and even without a patrol car. This led to conflicts, which will not happen now - it will be possible to stop everyone in a row and everywhere.

And the driver can verify the legitimacy of the work of the crew by calling the duty department of the traffic police.

2. Traffic police ambushes, described in numerous anecdotes, are now legalized. On the one hand, the regulation notes: “The patrol car must always be clearly visible from afar to all road users”, on the other hand, “if photo and video recording of violations is carried out, as well as on emergency sections of roads, the traffic police car can be masked using natural terrain in places with limited visibility. 4. The regulation establishes a new rule, according to which inspectors will be able to use "special technical means" (primarily cameras) belonging not only to the state, but also to "municipal bodies, public associations and organizations."

According to the traffic police, the meaning of the amendment is that in some regions automatic cameras belong to private companies, that is, the State traffic inspectorate has an indirect relationship with them. But now inspectors can use them too.

5. The new regulation removed the norm allowing the filming of traffic police inspectors. If earlier a traffic police officer had no right to prohibit filming, now he can simply say “do not film me, I am against it” - and the citizen is obliged to remove the video camera.

6. According to the new regulation, "the inspector has the right to ask the driver to get out of the car in case of signs of intoxication or illness." Simply put, the driver must ALWAYS get out when the "traffic cop" requires it. He will also have to get into a patrol car, if the peace officer wants it.

7. A separate paragraph in the regulations states that the basis for an examination for the state of alcoholic intoxication is the smell of alcohol from the mouth, posture instability, speech impairment, a sharp change in facial skin color, behavior that does not correspond to the situation. At the same time, before the examination, the police officer is obliged to remove the driver from control in the presence of two witnesses or using video recording.

But if the medical examination in the hospital shows that the motorist is sober, the inspectors are obliged to return him back to his car.

The corresponding initiative was contained in the version of the regulation published on the portal of regulatory legal acts.
