The village of Chulkovka in the Satka district is a typical Ural outback with the only peculiarity that the city-forming enterprise here is not a factory or a factory, but a psycho-neurological boarding school (SPNI). He gives people jobs, builds houses, repairs roads, arranges holidays.

In 2000, the director of the SPNI, Gennady Korolev, and his wife, a private entrepreneur, Almira Gabitova, built a ski resort (SLC) "At Vilya" in Chulkovka. There is no school, no club, no circles or sections in the village, so he very soon became the most popular place leisure activities not only for local children and adults, but also for fans of the “presidential” sport from all over the area.

For 10 years, a generation of skiers and snowboarders has grown up here. Their own champions also appeared: Vasily Kutuzov, a resident of Chulkovka, became the winner of the border cross for the Zavyalikha Cup, Igor Gabitov took third place in snowboarding at the regional sports contest "Olympic Hopes" in Abzakovo. Since the U Vilya complex is the only one in the region, the Satka children's sports school trains here, the pupil of which skier Valeria Kharina won the first two places at the Starts of Hope sports contest in Sochi this year, and her teammate Matvey Kotelnikov became the second. On Health Day, the ski lift works free of charge for SPNI employees, and winter sports days are also held for their wards. During the season, the GLK "U Vilya" passes up to 50 thousand people. There is equipment rental, a tubing track, a snowcat for leveling the slope, snowmobiles, a parachute for lovers of mountain extreme sports.

In May 2005, entrepreneurs decided to expand their business, and the training of athletes required the construction of a new, steeper and longer track. A. Gabitova wrote to the forestry agency for the Chelyabinsk region a statement of withdrawal forest area in the state forest fund of the Suleinsky forestry for the equipment of another ski slope and construction of a towing cableway. It was in May 2005. A couple of months later, an agreement between the Satka forestry and Gabitova was drawn up, the forestry promised to prepare all the necessary technical documentation. On May 4, the work was completed, paid for by customers and approved by the head of the forestry agency Z. Kamaletdinov. The director of the Satka forestry E. A plan-scheme of the site was drawn up, a sanitary-epidemiological conclusion was received, and if the situation had developed in the same direction, perhaps Korolev and Gabitova would soon complete the execution of a full package of documents. But on January 1, 2007, a new Forest Code came into force, providing for the allocation of plots only on an auction basis.

The Queen and Gabitova had to start all over again. They applied, paid for the application for participation in the auction, won it. Since the lease agreement was already in hand and it only remained to document it in the registration chamber, the entrepreneurs decided to start uprooting the forest on the forest plot transferred for use. They explained this not so much by the desire to get to work as soon as possible, but by fears for the safety of the equipment stored under open sky, and it was high time to start repaying a bank loan of three million rubles.

For almost two weeks, the machinery uprooted the forest, preparing the future construction site. But when Korolev came to the registration chamber, Marina Aksenova, deputy head of the Satka department of the state registration department of the Rosreestr department for the Chelyabinsk region, refused to register the lease agreement on the grounds that the 4.9-hectare plot that Gabitova won at the auction was located on the territory of the site, earlier leased to another Satka businessman A. Somkin. In addition, the registrar drew attention to the fact that before transferring the plot to Gabitova or someone else, it is necessary to register the ownership of the Russian Federation on it.

The process of arranging a new slope hung like a faulty computer. Time was playing against entrepreneurs. On April 24, 2008, the Satka Forestry wrote a letter to Gabitova, stating that illegal logging caused damage to forestry in the amount of 2,182,376 rubles. And on November 25 of the same year, the GLU informed Gabitov about the inventory of forest plots and that now, “in connection with the clarification of the boundaries, the IP A.E. Somkin, forest plots are not imposed on the plot provided to you for use. The letter ended optimistically: "To date, there are no obstacles to the state registration of your lease agreement for a forest plot ... there are."

We are still waiting like manna from heaven for the opportunity to register this document, - says Gennady Korolev. - However, in the supplementary agreement to the forest plot lease agreement, the forest management unilaterally changed the terms of the agreement, adding a clause stating that capital construction facilities should not be erected on the leased plot. If we agree that we cannot build a towing and cableway, which, as you know, refers to capital construction projects, then why do we need such an agreement? We will sign the agreement only if the forest management removes this clause.

To resolve the conflict, Gabitova wrote a letter to the forest management with a proposal to return the wood and plant new trees. She was refused: they say, we are not an implementing organization, and planting a forest for an amateur is just as dangerous as cutting down, it can be harmful. While negotiations and trials were going on, two million with penalties turned into four. The situation has reached an impasse. The forest was destroyed in vain. There will be no new ski slope. And the old one is unlikely to survive if entrepreneurs have to pay fines in full. Plans for business development collapsed, and the deputy of the Romanovsky settlement, the honored worker of social security Gennady Korolev and his wife Almira Gabitova suddenly became almost criminals.

The old Forest Code allowed the use of forest plots for one or more purposes by one or more entrepreneurs, - says Oleg GOLUBKOV, head of the legal department of forest management. - Therefore, we do not see a violation in the fact that Gabitova's site was located on Somkin's site - one was engaged in logging, and the other designed the site for recreational activities. In the new edition, the principle of multiple use has been preserved, but a lease agreement can now be concluded with only one entrepreneur.

- It turns out that Gabitova and Korolev are victims of legislative leapfrog?

Not at all. We immediately made an additional agreement, excluded the area of ​​the Gabitova site from the territory of Somkin, all changes were registered in the chamber. A letter stating that Gabitova has no obstacles to registration was sent in February 2009. But to register the contract in the registration chamber is not all. We need a project for the development of forests, expertise. Not everything in the forest can be cut down, if Gabitova had a project, they would say that it was possible to cut, for example, not 700 cubic meters, but only 240. In general, it could happen that they rented a plot, but they were not allowed to use it for felling , would allow houses to be placed pointwise, and that's all.

In addition, in areas designated for recreational activities, it is possible to build capital construction objects (and the cable-towing road is just such an object) only if they fall into the forest plan approved by the governor. There is another option: in order to build capital structures, it is necessary to remove the territory from the forest fund into non-forest. This is done through Moscow, the government, the documents are signed personally by Putin. That is, there are ways out, but people want to follow the path of least resistance.

- Explain the issue with the registration of the right of the Russian Federation to forest plots.

Usually, registrars proceed from the fact that someone's property right, regional, municipal or federal, in this case, the property of the Russian Federation, must be registered for the object. Somkin had registered the lease and ownership of the Russian Federation for one large piece. Gabitova came to register her five hectares, but the site has not yet been allocated from Somkinsky. They began to do it in fact. The federal property administration annulled the big green land, Somkin was given a new green land without these five hectares, and a separate certificate of ownership of the Russian Federation was received for Gabitova's plot.

Representatives of our department, the registration chamber, landowners, cadastral officers are constantly gathering to decide how to get out of this confusing situation.

- Are you referring to the situation with Korolyov and Gabitova?

This situation is typical. The government obliged to register the entire forest fund within six months. By 2002, forests were recorded in huge chunks. Now, if, for example, there are 100 applications for plots located on these huge pieces, then in order to provide them for rent, it is necessary to cancel the ownership of the Russian Federation every time on a huge plot. And then draw it up again, taking into account the isolated plots, for which it is also necessary to draw up a separate ownership right of the Russian Federation, because the plot must be independent, it cannot be inside another plot. This work is ongoing and there is no way out of it. The registration chamber, cadastral officers, landowners - all keep their own records. We are going to, and how many applications there will be, how many times we will cancel the right of the Russian Federation to a large section and then restore it in another new, specified amount. Previously, there was a territorial property administration with appropriate powers, and we did work through the region. Now with these questions we send people to Moscow, which closed everything on itself. Previously, issues were resolved in a month or two, but now they sent applications to the capital in January - there is still no answer. The legal department of Orenburg called, they had 172 applications sent to Moscow in December last year, but there was no answer either. The new Forest Code made everything more complicated, made it necessary to carry out activities that formerly the state gave money to the leshozes, for the tenants themselves.

Korolev is not the only one who got into this situation. A lease agreement was concluded with six more entrepreneurs for Somkin's site. Everyone had problems, because the new Forest Code prohibits the lease of the same plot to several entrepreneurs. Somkin was the first, that's why he registered the right to lease, if Korolev had been the first, his contract would have been registered.
