Mandatory fingerprinting. Fingerprinting of foreign citizens: fingerprints of a migrant for a patent, RVP, residence permit. How is fingerprinting done? Procedure for taking fingerprints of foreign citizens

Fingerprinting, to put it simply, fingerprinting- this is a procedure that is known to almost every citizen - someone from films, and someone from personal experience. Fingerprinting is considered a forensic procedure, and until this year it was used in strictly defined cases (we will discuss which ones below). However, this year, the administrative regulations of the Ministry of Internal Affairs of the Russian Federation approved the procedure for voluntary fingerprinting of citizens. Thus, today, every citizen has the opportunity voluntarily apply for fingerprint registration of their fingerprints. Let's try to figure out what the procedure for voluntary fingerprinting is and how much Russians need it.

The revision of the Schengen Borders Code in line with the findings of the November Council calls for the presidency of Luxembourg, Interior Minister Thomas de Maiziere and French Interior Minister Bernard Katsenev. The Czech Ministry of the Interior has published a summary of the letter from both ministers.

According to the proposal of both ministers, the minimum control should be changed in the systematic lustration and European data, since fingerprints and photographs from external borders European Union must be kept in the registry. In order to border control was more efficient, relevant databases should be linked and systematically used in security control systems.

Fingerprint registration of citizens - the need for a procedure

Until now, 2012, mandatory fingerprinting used only in a number of strictly defined cases. So, Citizens were subject to mandatory fingerprinting:

For one reason or another, those who ended up in police stations (these include detainees, suspects, accused in various cases of offenses or crimes)

Fingerprinting for a patent to work for a foreign citizen

It concerned foreign citizens from third countries with 90 days of short stay or 180 times. The system stores fingerprints and personal data, travel documents, entry and exit data, and visas. The system will steadily fall on the Europeans.

To this end, the registration centers necessary for the identification of foreigners should be operational for third-country nationals by the end of this year, urgently requested by the ministers. However, this proposal does not contain any measures that would force asylum seekers and immigrants to register anywhere.

Employees of law enforcement agencies, as well as employees in certain departments ( civilian pilots, sailors, rivermen, firefighters). Each department, as a rule, maintains its own records of employees who have undergone the fingerprinting procedure.

Those traveling abroad (in connection with the introduction of biometric passports required to travel to many foreign countries, many citizens undergo the fingerprinting procedure).

Both ministers, in the context of Luxembourg's presidency, apologize for the proposed measures - to migrants. Therefore, we must take steps to prevent would-be criminals and terrorists from exploiting and infiltrating desperate refugee situations.

This sounds like a great idea: forget your passwords and fingerprint your phone instead. This is a convenient security, though not as secure as you might think. Smartphones and other devices have more and more scanners that users can identify with these biometric signatures when they need to unlock a device, open a mailbox, or allow an electronic payment. Hackers can steal a fingerprint or its digital footprint. The police have wide legal power to force a user to unlock their phone.

As seen from the above list, in without fail fingerprinting - in most cases, not ordinary citizens are subject to, but persons to whom such a procedure is imputed by their official position, or citizens who have committed an unlawful act. The need for fingerprinting in these cases is obvious. However, as necessary for ordinary people(excluding cases of travel abroad) is this event?

So-called biometric systems are so practical that they can create a false sense of security for users. Others use the same password for all online accounts, which can then be attacked at once. Some don't even use a password.

Since electric sensors and microprocessors are cheaper and more powerful, manufacturers are starting to equip them with the most common devices. All of these devices consider each print, face, or iris to be unique. But that doesn't mean they can't copy. Jane and his two colleagues created a digital copy of the prints, edited and printed using special inks that mimic the conductive properties of human skin. "We tried the thumb right hand and now it worked,” says Jane.

The legislators explain the relevance and necessity of adopting the above Order by the fact that the creation of a single database for registering citizens by their fingerprints will greatly simplify the procedure for identifying persons, and will be extremely useful both to specialized departments and to all other citizens. So, in particular, in connection with the constant movement of citizens from one city to another, associated, in most cases, with job searches, the method does not always work - citizens simply do not get registered. At the same time, cases of death of such unregistered persons have become more frequent; and, as a rule, such citizens do not have documents that allow identifying a person. The presence of fingerprints in the relevant databases would help in such situations to identify citizens and notify their relatives in a timely manner about the tragedy. Fingerprint registration would significantly reduce the lists of missing and unidentified citizens.

Some experts believe that every biometric system can be solved with some definition. Simulated shots of someone's face, face, or iris. And if someone does, you can't just change your fingerprints or facial features like you would change a stolen password. To make such theft difficult, biometric-equipped phones and computers use encrypted fingerprints and store them locally rather than in the cloud, as hackers can steal them from corporate servers.

But biometric data can be obtained elsewhere. For example, leaving an imprint on the glass. Most thieves probably won't want to do this. But some experts express another concern - that biometrics undermines important legal rights for individuals. Since a person cannot be compelled to testify against himself, the courts cannot require the disclosure of a password. However, over the past two years, courts in Virginia and Texas have ordered defendants to unlock their phones with fingerprints.

In addition, due to the increased Lately man-made, natural and other types of disasters, many citizens are left not only without basic necessities, but also without any documents. In the presence of fingerprint registration the procedure for recovering documents, in this case, will be much faster.

So while you can't get someone to divulge the code in the safe, Supreme Court can order a person to open the key to the door. “Getting a fingerprint or scanning the iris is not the same as getting a person to talk,” says George Washington University professor Orin Kerr, professor of law. "It's just another way to access a computer, but with different means," he adds.

The Supreme Administrative Court said that the boss cannot take fingerprints from employees to control working hours, even if they agree to it. The case concerned one of the tax authorities, where employees were given the choice of whether they wanted to register their working hours using a magnetic card or their finger. Everyone decided to record their time with fingerprints. The resulting image was then processed by the binary code. The employee name has been assigned to a code.

In a word, advantages of voluntary fingerprinting quite a bit of. But one cannot ignore cons of this procedure about which many experts speak. So, in particular, the question arises, how well will information about fingerprinted citizens be protected? Will it become available to attackers who can use it for their own unseemly purposes? Which of the departments, and to what extent will such information be provided, as well as for what purpose? Won't this entail a wave of abuses by law enforcement agencies? Also relevant is the question of preserving the rights of citizens to privacy, in connection with universal fingerprinting.

The Secretary General of the Data Protection Inspector disputed this practice. He stated that he violated Art. 221 of the Labor Code. Under this provision, an employer may only require an employee to provide data if this is specified in this provision.

The head of the tax office claimed that the workers themselves had agreed to this. Management acted in accordance with Art. 23 p. 1 paragraph 1 of the Law on the Protection of Personal Data, which recognizes the processing of data as acceptable if the data subject expresses his consent. Therefore, the head of state considered that the processing of biometric data in his tax office is legal. He disagreed with the Administrative Court of the Voivodeship in Warsaw or considered the cassation appeal of the Higher Administrative Court.

In a word, while the legislators left it up to our discretion to undergo the fingerprinting procedure or not. However, a bill is already being prepared on the mandatory fingerprinting of all adult citizens in the territory of the Russian Federation. It is assumed that this law will come into force in 2013, and he will oblige to appear, according to the summons sent to citizens, to all the indicated persons for fingerprinting. Persons who ignore the subpoenas will be fined. Well, while this law has not yet entered into force, let's get acquainted with the voluntary procedure for fingerprinting.

In general, the imbalance in the relationship between the employer and the employee raises the question of voluntary consent to the collection and processing of personal data. Adequacy is based on the obligation to process correct data by administrators in accordance with the purposes for which they were collected.

The procedure for passing fingerprint registration

Brazilian officials have announced that 11 of the 50 bodies recovered from Atlantic waters, where the Air France crashed. On this moment the authorities did not declare the alien's citizenship. Children under 12 will be exempted from being fingerprinted for biometric visas given that fingerprints develop over time and are not reliable enough to identify them before that age, the European Parliament said on Wednesday. This change was made on the recommendation of European Parliamentarian Sarah Ludford and is the result of an agreement with the Council of the European Union.

The procedure for passing fingerprint registration

So, Order of the Ministry of Internal Affairs "On approval administrative regulations to provide public service on conducting voluntary state fingerprint registration", established a single standard for passing this procedure for all regions. The Order contains the addresses of departments of internal affairs bodies in different cities countries where fingerprints can be taken. This procedure is carried out for Russian citizens for free. For all issues related to fingerprinting, citizens can seek advice from the relevant departments in person, by phone or send a written request.

In order to get fingerprinted, the citizen is obliged to write a statement. No other certificates and documents (with the exception of a passport or birth certificate, if the person is under 14 years old, other binding documentsp.p.16.4-16.6 of the Order), to undergo the fingerprinting procedure, citizens are not required. It should be noted that a person who has voluntarily passed fingerprint registration has the right to subsequently refuse it and demand the destruction of the results of fingerprinting (in this case, he is issued a notification about the destruction of the citizen's fingerprint information).

After passing the appropriate procedure, the person is issued certificate of voluntary state fingerprint registration. If for one reason or another a citizen is denied the fingerprinting procedure, he is also required to issue a notice of refusal. In said order ( p.p.18 - 21) contains exhaustive grounds for refusal to accept documents, applications in electronic form and provide fingerprinting services. Basically, the reasons for refusal come down to errors in filling out documents, providing false information, the lack of Russian citizenship from a citizen (fingerprints are taken from foreigners only if they have violated the law), physical damage to fingers that interfere with fingerprinting, etc.

On the basis of the application submitted by the person, the official issues a coupon to the citizen, consisting of two parts: a voucher-stub and a confirmation voucher. Both parts of the coupon have the same registration number. The applicant signs for receipt of the confirmation coupon on the stub, puts down the date and time of receipt of the confirmation coupon. On the basis of this confirmation coupon, the fingerprinting procedure is carried out directly.

I would like to note that in accordance with this Order, fingerprinting is carried out both by means of an electronic fingerprint scanner and by the ink method.

Thus, the procedure for voluntary fingerprinting does not present any particular difficulties.
