New, not yet effective rules for receiving driving licenses may undergo further changes. The Federation of Associations of Driving Schools sent a letter to the Ministry of Justice with claims to the regulations developed by the traffic police. The auto instructors considered the new rules to be too strict, although the draft document had previously received the approval of all interested parties. It is possible, however, that the objections of driving schools are dictated not so much by concern for customers as by the situation on the market. Last year, those wishing to gain the right to drive have noticeably decreased, which forced driving schools to reduce prices. Less money - more hassle

Contrary to popular belief, prices once raised are sometimes lowered. In Russia, this happened in the field of driver training. In the capital, for example, the cost of such services, according to Last year decreased on average from 40-45 thousand to 25-30 thousand rubles.

The number of customers has really gone down. According to the traffic police, in 2015, 1.87 million people were issued driver's licenses, which is 600,000 less than in 2014. According to the new regulations, one mistake in passing the theory entails five additional questions. At the same time, all 20 theoretical questions must be answered in 30 minutes. The same amount of time is given on the site. There you will need to complete not three out of ten (as now), but five out of seventeen exercises. Among the new products - "Parking in reverse and exit from parking space” and “Stop for the safe embarkation or disembarkation of passengers”.

The well-known advice of instructors to inept students - "move like a snail" - will lose its relevance. The same "snake" will need to be overcome in a maximum of two minutes. And in order to avoid any assistance, employees of driving schools will be banned from attending exams.

Not surprisingly, these requirements have caused discontent in training organizations. As a result, driving schools will need to teach cadets cheaper, but better, to guarantee successful delivery more difficult exam. Otherwise, the reputation of the school will suffer, which will immediately affect the number of customers.

The position of the State traffic inspectorate is quite simple. The agency continues the large-scale reform of the driver training system that began back in 2013. The main task is to allow participation in road traffic only well-prepared for this people.

“The novelties of the regulation are based on international experience and are aimed at increasing the objectivity of assessing the professional qualities of a candidate for drivers,” Anton Belan, a traffic police spokesman, told Lente.ru, emphasizing that now those with whom he had already been agreed upon earlier oppose the document.

The document, prepared by the Ministry of Internal Affairs, was sent to the Ministry of Justice for registration in the fall of 2015. Prior to this, the draft regulation was posted for discussion on the official website of the law enforcement agency and on the regulation.gov.ru resource.

“A significant number of comments and suggestions from the public, including educational organizations that train drivers of vehicles, have been taken into account,” the State traffic inspectorate assures. - A corresponding conclusion of the Ministry of Economic Development of Russia has been received for the draft administrative regulation. The comments contained in this conclusion were also taken into account when finalizing the provisions of the draft.

Tatyana Shutyleva, President of the Federation of Driving School Associations, agrees that the big job. However, the final version of the document, according to her, differs from the agreed one.

“The text submitted to the Ministry of Justice is not at all the same text that was discussed and finalized at the open area, - Shutyleva told Lente.ru. “In particular, there were suddenly time limits and a ban on the presence of an instructor when passing a driving test.”

The State Traffic Inspectorate replied that the limitation on timing is provided for in Appendix No. 1 to the “Rules for conducting exams for the right to drive vehicles and issuance of driving licenses”, approved by the government in October 2014. And the presence of instructors in the department was recognized as an inappropriate relic of the past, when citizens had the right to self-training and when passing the exams were not perceived as professionals.

“Behind the wheel of a car is no longer a student, but a driver candidate who has undergone appropriate professional training and has a document confirming its successful completion,” the traffic police explained. "In this regard, the presence of a driving instructor in the examination vehicle is unacceptable."

Driving schools believe that this requirement is contrary to clause 2.7 of the SDA and creates additional risks during exams. In support of their words, they collected documents about emergency situations, created during the exercises on the site, when the candidates were left alone.

However, some of the claims of the Federation of Driving Schools, expressed in a letter to the Ministry of Justice, testify to a banal misunderstanding.

In particular, questions arose regarding the plans of the Ministry of Internal Affairs to increase the period for issuing driving documents from one to 30 days. The ministry claims that this period of time is specified in the regulations as the maximum for the entire range of actions, starting with the receipt of an application for obtaining rights and ending with the issuance of a crust. According to Anton Belan, everything can be done in a few hours.

Tatyana Shutyleva insists that the final text of the document be agreed with the public and the association, and the traffic police refer to the rules for development and approval administrative regulations, which do not involve posting a draft document on the web after it has been finalized.

However, at present, according to Shutyleva, the department and the public have managed to find mutual language. The document is again being finalized, and now it is not clear when and in what version it will be adopted.

The only thing that is known for sure is that the rules for passing the exam will be tightened, but those who started training at a driving school under the old regulations will not be examined according to the new requirements in the traffic police.

The Federation of Associations of Driving Schools hopes that the demand for their services will remain stable. A significant reduction in clients of driving schools, according to Shutyleva, is due not so much to the deterioration of the economic situation in 2015 as to the rush demand at the end of 2014.

IV. The procedure for issuing and replacing driver's licenses

32. Candidates for drivers who have passed the necessary exams, on the basis of the protocol, are issued driver's licenses and temporary permits, the series and numbers of which are recorded in the register of issuing driver's licenses and temporary permits for the right to drive vehicles (Appendix 4).

33. A driver's license is issued for a period of 10 years. After the expiration of the period specified in it, it is considered invalid and must be replaced in the manner prescribed by the Rules and these Instructions.

34. Driving license issued in the territory Russian Federation until January 1, 1998, valid for the period specified therein. If no expiration date is specified, it is valid until January 1, 2000.

Driver's license with the distinguishing sign "SU" obtained in the republics former Union SSR in the period up to January 1, 1992 by a citizen registered at the place of residence on the territory of a constituent entity of the Russian Federation, valid until January 1, 2000.

The driver's licenses specified in this paragraph shall be replaced after the expiration of the period of validity in the manner established by paragraph 46 of this Instruction.

35. Filling in driver's licenses and temporary permits is carried out in Russian on printing devices, with special ink, and in exceptional cases - with black paste. In the driver's license, all entries, with the exception of those filled in in the columns "Patronymic" and "Special Marks", must be simultaneously duplicated in Latin letters. Correspondence table for Russians and Latin letters approved by Order of the Ministry of Internal Affairs of Russia dated November 26, 1996 N 624 "On the procedure for registering vehicles" (registered with the Ministry of Justice of the Russian Federation on December 30, 1996, registration N 1223).

36. In the columns of the categories of vehicles for which a driver's license is issued, permitting marks are affixed by duplicating the letter corresponding to this category of vehicle, or by writing (stamping) "Permitted". Columns of other categories of vehicles are canceled by affixing a stamp with a diagonal stripe or in another way. Similar columns of temporary permission are canceled by crossing them out or punching a round punch.

37. In the column of the driver's license "Special Marks" permitting marks are put down for the right to drive a tram, trolleybus, and other necessary records are entered (length of service, blood type, etc.). 38. After passing a practical exam for the right to drive trains of vehicles, a permit mark is made in category "E" and, if the tractor is a vehicle of category "B", in the column "Special Marks" an entry "E" to "B" is made, if " C", then "E" to "C", if "D" - "E" to "D". If the driver is granted the right to drive a combination of vehicles with a tractor of category "C" and an articulated bus, an entry "E" is made to "C, D". In column "E" of the temporary permit in these cases, the corresponding category of vehicles to which the tractor belongs - "B", "C", "D" or "C, D" shall be entered.

39. Upon receipt of a permit for the right to drive vehicles of another category, the previously issued driver's license and temporary permit are withdrawn, and the permit marks and necessary entries are transferred to the appropriate columns of the new driver's license and temporary permit.

40. The procedure for issuing, including after the loss, and replacement of temporary permits is established by this Instruction, as well as other regulatory acts of the Ministry of Internal Affairs of Russia.

41. A driver's license and a temporary permit are issued to the owner against a personal signature in the register of issuance of driver's licenses and temporary permits or in an application for automated production of driver's licenses.

Note. If the driver's license contains an entry (stamped) "Medical certificate is required", the holder of the license is warned about the need to have a medical certificate when driving.

42. Prior to taking exams and issuing a driver's license for the first time or in exchange for a lost (stolen) and when replacing a license, an appropriate check is made against databases of drivers deprived of the right to drive vehicles, databases of distributed, as well as databases of lost (stolen) forms of driver's licenses , about which an appropriate note is made in the application by an official of the State traffic inspectorate.

43. When issuing a driver's license, the date, series and number of the issued certificate, the categories of vehicles the owner has the right to drive, as well as the name of the department of the State traffic inspectorate that issued it, are recorded in the driver's card and the training document. The records made are certified by the signature of the official and the seal of the State Traffic Inspectorate.

44. When a driver's license is issued, the driver's card and the training document, after making the necessary entries in them, are returned to their owner.

45. To replace a driver's license, the documents specified in paragraph 18 of this Instruction are submitted to the State traffic inspectorate.

In the absence of a driver's card, other documents confirming the issuance of a driver's license are submitted: confirmation of the issuance of a license by other divisions of the State Traffic Inspectorate, a temporary permit, which indicates the series and number of the driver's license, or a document on training if it contains information about the issued driver's license, certified by a seal State traffic inspectorate.

In the absence of a driver's card and other documents confirming the issuance of a driver's license, as well as in case of doubt about the authenticity of a driver's license (the seal is poorly distinguishable, entries made, there are erasures), the State traffic inspectorate sends a request to the State traffic inspectorate at the place of issuance of the certificate by mail using formalized form (Appendix 5) or telegraph, teletype, electronic or other communication. Execution of requests is made within five days from the date of their receipt using the specified means of communication.

46. ​​Replacement of driver's licenses is made without passing exams, except for the cases specified in paragraphs 55, 56 and 59 of this Instruction.

47. When replacing a driver's license confirming the right to drive vehicles of several categories, and the driver submits a medical certificate of fitness to drive one or some of them, permitting marks are affixed only in the appropriate columns of the certificate.

Restoration of permit marks is carried out at the request of the owner after the presentation of the relevant medical certificate and documents confirming their presence in the previously held driver's license, without passing exams.

48. A driver's license and a temporary permit in exchange for lost (stolen) ones are issued upon presentation of the documents specified in paragraph 45 of this Instruction, after passing the theoretical and practical exams, except for the cases specified in paragraph 51 of this Instruction.

At the same time, at the discretion of the examiner, exams are taken for the right to drive a vehicle of one of the categories, the right to drive which was confirmed by the existing certificate.

49. If a driver's license is lost, the temporary permit issued to him is considered invalid and is subject to surrender to the State traffic inspectorate.

50. If necessary (checking databases of drivers deprived of the right to drive vehicles, clarifying individual circumstances of loss), instead of a driver’s license, the issuance of which is provided for in paragraph 48 of these Instructions, after passing the relevant exams, the applicant may be issued a temporary permit for up to 2 months .

In the issued temporary permit, instead of the series and number of the driver's license, the entry "Instead of the lost" is made. These temporary permits are accounted for in a separate register, the form of which is provided in Appendix 4 to these Instructions.

Upon completion of the necessary checks, this temporary permit is withdrawn and attached to the materials that served as the basis for its issuance, and the driver is issued a driver's license and a temporary permit without passing exams.

51. Issuance of driver's licenses to replace those lost during natural disaster, flood, fire and in other emergencies, if this is confirmed by the relevant documents, is carried out without passing exams.

In other exceptional cases, when the loss of a driver's license occurred due to reasons beyond the control of its owner (for example, the loss of a certificate due to the fault of the internal affairs bodies, communications, in the event that illegal actions were committed against the owner of the certificate), a new driver's license is issued without passing exams. decision of the Chief State Automobile Inspector of the Russian Federation (his deputies), chief state automobile inspectors of the constituent entities of the Russian Federation (their deputies) when submitting supporting documents.

52. Return of driver's licenses to persons deprived in accordance with the current legislation of the Russian Federation of the right to drive vehicles, the period of deprivation of the said right has expired and 12 months or more have passed since the issuance of the relevant decision, is made after mandatory passage medical re-examination and passing theoretical and practical exams.

At the same time, at the discretion of the examiner, exams are taken for the right to drive a vehicle of one of the categories, the right to drive which they were deprived of.

53. Driver's licenses and temporary permits, in exchange for which new owners were issued, are considered invalid and are subject to surrender to the State traffic inspectorate for destruction.

It is not allowed for citizens to have 2 or more driving licenses and temporary permits at the same time.

54. International or national driving licenses obtained by citizens of the Russian Federation while living in other states that meet the requirements of the Convention on Road Traffic<*>, adopted in Vienna in 1968, are valid on the territory of the Russian Federation only when driving vehicles participating in international traffic, or other vehicles by citizens who arrived in the Russian Federation for up to 6 months. Other national certificates are valid in the presence of their translation certified in the prescribed manner.

Note. In accordance with the Convention, a vehicle is considered to be participating in international traffic on the territory of the Russian Federation if it belongs to to an individual, not registered at the place of residence or stay on the territory of the Russian Federation, or legal entity, not duly registered in the Russian Federation; temporarily imported into the Russian Federation.

55. If the owner of the driver's license specified in paragraph 54 of these Instructions arrives at the place of residence in the Russian Federation or lives in the Russian Federation for 6 months or more, his driver's license becomes invalid and can be exchanged for a corresponding Russian license after passing a medical examination and passing theoretical exam. In this case, a copy of the international or national driver's license or its translation certified in the prescribed manner is filed into the materials that served as the basis for their issuance, and the certificate is returned to the owner.

56. Replacement of driving licenses obtained in the republics of the former USSR after January 1, 1992, as well as national driver's licenses of the CIS member states, is carried out in accordance with paragraph 55 of this Instruction.

57. When issuing driver's licenses not at the place of residence of a citizen (at the place of stay or in the cases specified in paragraph 7 of this Instruction), information about this (a copy of the driver's card) is sent to the State traffic inspectorate at the registered place of residence for appropriate accounting (inclusion in automated databases ) issued driver's licenses.

Particular attention should be paid to points “a”, “b” and “c”, because under these conditions driving a vehicle is equivalent to driving without a license (part 1 of article 12.7 of the Code of Administrative Offenses of the Russian Federation: a fine of 5,000 to 15,000 rubles).

As before, it is not required to take exams to replace driving licenses in cases a), b), c), e), g).

There is one controversial issue!

How to be those women who changed their last name before November 5, 2014, but did not change their driver's license? Is their certificate valid, or has it become invalid since 11/05/2014?

I called two traffic police departments(I called more departments, but I managed to get through to only two), asked the question - is it necessary to change certificates in such a situation? In both departments, they told me that I needed to change the VU (driver's license).

After that, 11/11/2014, I made an official request to the GUOBDD of the Ministry of Internal Affairs of Russia for clarification of this issue. So far no response has been received. Will wait.

The thing is that I think it is not necessary to change a driver's license if the surname has changed before 11/05/2014. As you know, a normative legal act establishing new obligations does not have retroactive effect. In addition, paragraph 27 of the new "Rules for conducting examinations for the right to drive vehicles and issuing driver's licenses" says that the Russian national driver's license issued before the entry into force of the Rules is valid until the expiration of the period specified in it.

That's why those who changed their last name after November 5, 2014 must change their driver's license. But in the case of a change of surname before November 5, 2014, in my opinion, it is not necessary to change the VU. However, let's wait for an official response from the GUOBDD of the Ministry of Internal Affairs of Russia until I insist on my point of view.

Certainly, it is possible to change other personal data of the driver contained in the driver's license. We are just talking now about the most common option.

Note. Since November 5, 2014, the old rules (Decree of the Government of the Russian Federation dated December 15, 1999 No. 1396 “On approval of the Rules for passing qualification exams and issuing driver's licenses”) have become invalid. From the same day, new rules are in effect - Decree of the Government of the Russian Federation of October 24, 2014 No. 1097 "On admission to drive vehicles" (together with the "Rules for conducting exams for the right to drive vehicles and issuing driver's licenses").

You can try to prove in court that the traffic police are wrong, and the driver's licenses of women who changed their names before November 5, 2014 are valid until their expiration date.
