Entry ban

A visa opened according to all the rules does not mean guaranteed entry into the country! Refusal to cross the border may be for the following reasons:

  • lack of documentary evidence of the purpose of entry;
  • passport, visa or other required document found to be fake;
  • the maximum allowable period of stay in Poland for a specific type of visa has been exceeded;
  • if it is required by the border crossing rules, but the entrant has not provided: medical insurance, proof of solvency, housing reservation or other necessary grounds;
  • the foreigner is on the list of undesirable persons;
  • the entrant is prohibited from crossing the EU border on the basis of an entry in the SIS;
  • the stay in the country of a foreigner is recognized as dangerous for national or public security, and is also a threat to the health of Poles.

Consequences of illegal entry into Poland

Staying in the country without the appropriate permits, after the expiration of their validity (or the maximum allowable period of stay), as well as in cases of administrative or judgments ordering to leave the Republic of Poland, forbidden!

The foreigner must leave the country immediately. If there are legal grounds for this (denial of an appeal, refugee status or similar status), a 15-30 day period is granted.

In case of violation of these norms, sanctions can be imposed in the form of forced deportation and a ban on entry for a period of 6 months to 5 years. The ban may apply only to Poland or to all ().

Types of violations and terms of prohibitions

Penalties for a period of 0.5 to 3 years are imposed for the following offenses:

  • stay in the Republic of Poland without a valid or invalid visa, passport or other necessary document;
  • did not leave the territory of the Republic of Poland after the end of the allowable period of stay, if it (the period) is provided for by the type of visa issued, incl. exceeded the period of stay in other EU countries;
  • there are no proven financial opportunities for further stay in the country and return to their homeland;
  • being outside the geographical area or exceeding the deadlines established by the small border traffic, if the entry was carried out in accordance with this method;
  • discrepancy between the declared purpose of stay and the actual one, if the legislation of the Republic of Poland and / or the EU does not provide for its adjustment;
  • stay in the country after the established period, in connection with the refusal to obtain the appropriate status (refugee, humanitarian and other purposes) or appeals on refusal.

The basis for a ban for a period of 1-3 years may be:

  • illegal employment and labor activity;
  • illegal business activity.

Entry ban for 3-5 years may be for reasons:

  • being on the SIS sanctions lists;
  • conviction by a Polish court and transfer to another country for execution of punishment;
  • a threat to the health of Polish society confirmed by a medical commission.

A recognized threat to the national security or defense capability of the Republic of Poland entails a ban on entry for a period of 5 years!
